May - August, 2013. Issue II

Some major regulatory changes introduced during the relevant period covered in this newsletter primarily relate to the following normative acts:

1. Appointment of Personal Data Protection Inspector in Georgia;

2. Amendments to the Order N°73/04 of the President of the National Bank of Georgia (dated September 7th, 2011) related to the rules of request and issuing  of an identification number of securities and registration statement of public offer and approved prospectus.

Some major legislative changes introduced during the relevant period covered in this newsletter primarily relate to the following normative acts:
1. Resolution of the Parliament of Georgia on Basic Directions of Georgia’s foreign policy;
2. Amendments to the Law of Georgia on the National Bank;
3. Amendments to the Law of Georgia on Microfinance Organizations;
4. Amendments to the Order of the President of the National Bank of Georgia №170/01;

Amendments to the Civil Code of Geprgia

March, 2012. Issue II

Amendments to the Civil Code of Georgia

On December 9th, 2011 amendments were introduced to the Civil Code of Georgia.

The amendments affected the right of redemption in sales contracts; namely term of redemption was set forth at maximum of ten years, with no possibility of further extension.

Also, amendments concerned the issue about establishing the origin of child from unmarried parents by: joint application of parents and child’s birth document; if such documents does not exist, the origin of the child is established by the court, but in cases specified by the law Civil Registry Agency has the authority of establishing origin of the child.

Recognition and enforcement of foreigh arbitral awards in Georgia

February, 2012. Issue I

Legal Grounds for Recognition and Enforcement of International (Foreign) Arbitral Awards in Georgia

1. Georgia has been a contracting state to 1958 New York Convention on Recognition and Enforcement of Foreign Arbitral Awards since 1994. In addition, recognition and enforcement of foreign arbitral awards is regulated by Law of Georgia on Arbitration (June 19, 2009), Law of Georgia on International Private Law (April 29, 1998) and Law of Georgia on Enforcement Proceedings (April 16, 1999).

Admission of pharmaceutical products into the Georgian market

Issue I, 2010

Admission of pharmaceutical products into the Georgian market may be granted by way of state registration through:
(a)   recognition regime; and
(b)  national regime.
Pharmaceutical products are deemed admitted into the market if they are registered with the Departmental Registry kept by the Agency of State Regulation of Medical Activities at the Ministry of Labor, Health and Social Protection of Georgia (the Agency).
